On January 26, 1962, plaintiff brought suit against defendants in the circuit court for the county of St. Clair seeking, among other things, a determination by the court that he was entitled to an overriding royalty interest in certain producing oil and gas wells situate in St. Clair county. The defendants had working interests in these wells.
