By its petition filed in the court below the appellant, Rudee Inlet Authority, sought to condemn the real property of the appellees in the city of Virginia Beach. In opposition the appellees filed a demurrer and a special plea to the petition. On consideration thereof, and on reasoning set forth in a written opinion, the court entered its decree adjudicating: (1) that the taking of private property for the uses and facilities authorized to be constructed...
