This is an action of case to recover for damages to the plaintiff's automobile as a result of a collision which occurred at about 11:15 P. M. on October 8, 1960 in Magog, P. Q., Canada. The defendant Leon Marquis filed a counterclaim for damages to his automobile, which was being operated by the named defendant at the time of collision.
