MATTHES, Circuit Judge.

After waiving the filing of an indictment, appellant with two other persons was charged in a multiple count information with violating 26 U.S.C. §§ 4742(a) and 4744(a) (1954), as amended, 26 U.S.C. § 4744(a) (Supp.1956).1 All three defendants were found guilty and appealed from the judgments of conviction.
