Leland Summers died testate in 1964, leaving his property to his widow and an adopted daughter, the principal appellees. At his death Leland was in possession of the 49 acres now in dispute. The appellants, Leland's seven children by his first wife, brought this suit for partition of the property. They contend that Leland received, under his father's will, only a life estate in the property, with the fee simple passing at Leland's death...
