This is an appeal from an order of dismissal pursuant to plaintiffs' motion for non-suit.

Plaintiffs, Ava Louise Roberson and the other trustees of Select Minority Trusts, brought this suit for declaratory judgment seeking to construe the terms of the trust indenture creating the trust.
