This matter is before the Court on defendant's motion to dismiss the plaintiff's amended complaint for failure to state a claim upon which relief can be granted. In the amended complaint the government asserts that defendant was unjustly enriched by having received on three occasions hospitalization services and goods from the Veteran's Administration Hospital in Denver, Colorado, without making payment.
