MEMORANDUM AND ORDER

RONALD N. DAVIES, District Judge.

On October 24, 1966, the Defendant filed with the Clerk an instrument styled "Motion for Affidavit of Prejudice."

This instrument apparently was filed pursuant to 28 U.S.C.A. Sec. 144, which provides:

"Whenever a party to any proceeding in a district court makes and files a timely and sufficient affidavit that the judge before whom the matter is pending has a personal bias or prejudice...
