This petition for habeas corpus was brought to obtain the petitioner's discharge from the allegedly unlawful custody of the respondent warden. The petitioner has been in the respondent's custody since April 10, 1964, at which time he was sentenced to a term of five years by a justice of the superior court on a plea of nolo contendere to an indictment charging him with larceny.
