This is an action by the testamentary executrix of the succession of Mrs. Birdie Carter Edmondson, deceased, against the decedent's surviving spouse to determine in a declaratory judgment that the succession is not indebted to him. The executrix further prayed that her rights, as the sole and only heir of the decedent and as executrix of the succession, to assert any claims against the defendant, be reserved.
