This is an appeal from a judgment denying recovery to appellant for alleged malicious prosecution and from an order denying a new trial.

November 7, 1960, appellant entered into a conditional sales contract with respondent, Ralph S. White, who was vice-president of respondent, White Hardware & Implement Co. in Payette, and manager of a New Plymouth store, for the purchase of a television set.
