CRAVEN, Circuit Judge:*

During the second week of January 1966, Richard T. Wehrle was put on trial for his life in the Superior Court of Mecklenburg County under two indictments, consolidated for purposes of trial, charging him with the capital felonies of burglary and rape. Verdicts of acquittal or not guilty were returned by the jury as to each indictment. On March 8, 1966, Wehrle filed suit in this court...
