After the trial in the superior court the indictment against defendant Stubbs, upon which he was tried, convicted, and sentenced, was lost. On 10 June 1965 defendant Stubbs filed in this Court a petition for a writ of certiorari alleging, inter alia, that in preparing his statement of case on appeal no indictment against him could be found in the records of Mecklenburg County Superior Court, and he could not proceed with his appeal,...
