Memorandum Findings of Fact and Opinion

ARUNDELL, Judge:

Respondent determined deficiencies in petitioner's income tax for the period May 22, 1958, to November 30, 1958, of $258,616.93, and for the fiscal year ending November 30, 1959, of $117,367.57.

Petitioner assigned error as follows:

(a) The Commissioner erred by including the income of Fairmount Steel Corporation in the income of the petitioner in the following amounts:
