MASON, Justice.

This is a negligence action by the estate of a deceased Des Moines waterworks employee claiming damages by reason of his untimely death.

Trial was to the court without a jury. The court found defendant negligent under the circumstances, decedent free from negligence, defendant's negligence was the proximate cause of decedent's death and damages.
