This litigation arose from a two car collision on Kentucky Highway 74 at the outskirts of Middlesboro. Appellee, Tommie Webb, was a passenger in the automobile operated by her husband, Wesley Webb. Appellant was the driver and sole occupant of the other car. Each of the Webbs sued appellant, and there have been two trials of the case.
