This is a motion for resentence, made it is claimed, pursuant to the provisions of section 1943 of the Penal Law, as amended. It appears from the petition that on or about June 1, 1951, the defendant was convicted in the Erie County Court, upon his plea of guilty to a charge of attempted grand larceny and received a 5 to 10-year sentence.
