The appellee, Desolee Thornhill, was tried on an indictment charging her with the murder of L.B. Polk, who was Sheriff of Marion County, Mississippi, at the time of the alleged assassination. After the State had introduced evidence and had rested its case, the defendant made a motion for a directed verdict of acquittal. This motion was at that time overruled.
