This appeal comes to this court on questions of law from a judgment entered for the defendant by the Common Pleas Court of Cuyahoga County after that court sustained defendant's demurrer to plaintiff's petition and reply, holding that the Common Pleas Court did not have jurisdiction to hear the claim of the plaintiff, the plaintiff not desiring to plead further. The irregularity of the filing of an answer which was not withdrawn before filing the demurrer...
