This is a tort action by plaintiff, Edgerson J. Fountain and his estranged wife, Marie Louise Lewis Fountain, for damages for the death of their fifteen year old son, Hosea James Fountain, who died June 25, 1962, as the result of a flogging administered by employees and officers of the State Industrial School for Colored Youths, Scotlandville, Louisiana, to which said institution said deceased youth had been committed by lawful authority.
