NORTHROP, District Judge:

This is an action arising under the Federal Employer's Liability Act (hereinafter FELA), 45 U.S.C.A. § 51 et seq., as the consequence of an accident which took place on March 31, 1964, in the District of Columbia. The accident resulted in the death of plaintiff's husband, Earl R. Huber, who was allegedly acting under the defendant's orders when it occurred. This suit is brought by the plaintiff, Dolores E. Huber, for her own benefit...
