TAPLEY, Justice.

On exceptions. The defendant, Leroy W. Merrow, was charged by complaint with the crime of operating a motor vehicle while under the influence of intoxicating liquor. The case was tried before a drawn jury at the September Term, 1963 of the Superior Court, within and for the County of Somerset and State of Maine. The jury returned a verdict of guilty, whereupon the defendant was sentenced. Counsel for the defendant seasonably filed exceptions.
