Plaintiff, Joseph Newton, a pedestrian, was struck by an automobile owned and being driven by defendant, Edward F. Cousin, while crossing a public highway in East Baton Rouge Parish, and instituted this action to recover damages from Cousin and his liability insurer, Hartford Accident and Indemnity Company, for personal injuries and incidental expense allegedly attributable thereto.
