As the result of a head-on collision on the night of October 24, 1964, Dale S. Jones, Jr., the insured, was killed. Marjorie A. Kelly, the wife of the plaintiff, John V. Kelly, was killed. The plaintiff was seriously injured and the plaintiffs brought action against the defendant, Capital, under the Guam Direct Action Statute.
