Plaintiff in error will be referred to as the defendant, and defendants in error as the plaintiffs.

This was an action brought by the plaintiffs to recover damages resulting from the "wrongful death" of one Mabel G. Baldwin. One of the plaintiffs was the executrix of the estate. All of the plaintiffs were heirs at law of Mabel G. Baldwin and they alleged that her death was caused by the negligence of the defendant.
