This negligence action was brought in 1955 by the plaintiff against the defendant to recover damages allegedly occasioned to the plaintiff on February 17, 1954. The case was tried in May, 1959, resulting in a verdict for the plaintiff. Defendant filed a motion for judgment notwithstanding the verdict which was granted by the trial court.
