This is an appeal on questions of law from a judgment convicting and sentencing the defendant for a violation of Section 3113.01, Revised Code, the defendant having been indicted for wilfully neglecting to provide his mentally handicapped child, Robert Turner, age 18 years, with necessary food, clothing and shelter.

The defendant assigns as error that:
