This controversy arose out of the following situation:

The Seaboard Air Line Railway Company, by deed dated March 20, 1909, acquired from The Atlantic Coast Terminal Company, Incorporated, certain parcels of land in the city of Portsmouth, together with all riparian rights appertaining thereto. The land so acquired bordered on Crawford's Bay, a part of Elizabeth River, a navigable tidal estuary...
