Petitioner Lane sued The Travelers Indemnity Company, respondent, on a fire insurance policy and to recover part of the premium which had been paid. The case was submitted to a jury on a number of special issues. Following return of the jury's verdict the trial court rendered judgment that the plaintiff take nothing. The Court of Civil Appeals modified the judgment to the extent of decreeing recovery...
