Sherrod and other Negroes sued Davis Jones, Mrs. Merlin Jones and Vance Jones jointly, alleging a violation of the Civil Rights Act of 1964 in that according to the complaint the above named defendants were owners of the Pink Hat Cafe located in Hollandale, Mississippi, and had refused service to the plaintiffs.
