Mrs. Adriel Miers, Jr., individually and as tutrix of her minor children, instituted this suit for damages for the death of her husband. The suit was originally filed against four parties, but it was dismissed as to two of them, leaving as the sole remaining defendants, Bailey Transportation Company, Inc., and its liability insurer, Truck Insurance Exchange.
