The plaintiff makes this motion for summary judgment in lieu of a complaint pursuant to CPLR 3213. The plaintiff served a summons with a notice of motion for summary judgment with a supporting affidavit. It was returnable 20 days after service. This was all done in compliance with CPLR 3213. The notice demanded that any answer be served five days prior to return day.
