Defendant was charged by information with burglary, second degree, and stealing, and, under the Habitual Criminal Act, with a prior felony. Sections 560.070, 560.110, 560.156. (Statutory references are to RSMo 1959 and V.A.M.S.) A jury found him guilty of burglary and stealing. Upon a finding by the court of the prior felony conviction, he was sentenced to a term of five years in the penitentiary for burglary and five years for stealing, the two sentences...
