By order of the probate court of Linn county the proceeds of the estate of Charles Barry, deceased, were paid into the escheat fund of the state of Oregon. The plaintiffs, a nephew and grandniece of the deceased, sought to recover these funds from the State Land Board as heirs and next of kin of the deceased in a circuit court action under the provisions of ORS 120.130 as authorized by ORS 117.310 (2).
