Pursuant to his arrest on March 14, 1964, in West Des Moines, Iowa, on a charge of operating a motor vehicle while intoxicated, Michael Lee Johnson, the defendant, was bound over to the Grand Jury, which returned an indictment on April 30, 1964, charging him with that offense in violation of section 321.281, Code of Iowa, 1962, I.C.
