In 1955 petitioner Schlette was indicted on two counts of arson, the first alleged to have been committed on September 9, 1954, the second on February 23, 1955. Both alleged acts involved fires at a tavern owned by petitioner and his wife. The jury returned a verdict of guilty on the first count but was unable to agree on the second.
