Douglas Davis brought an action in tort in the Superior Court of Douglas County against Howard Aiken, a resident of said county, Charles Hardy, a resident of Paulding County, and Jack Lane, a resident of Cobb County. The petition, omitting the formal parts and the allegations relating to injuries and doctor's bills, etc., is as follows:
