This appeal has been taken from a district court order dismissing appellant's complaint on four separate grounds, namely:

"(1) That the Second Amended Complaint fails to state a claim upon which relief can be granted. "(2) That the Defendants are immune from Civil Suit under the Civil Rights Act. "(3) That the Second Amended Complaint is barred by the applicable Statute of Limitations, Section 338(1) of the California Code...
