On two occasions early in the summer of 1958, while serving as a member of the crew of the respondent's ship, the libellant Domeracki fell from his bunk. The consequent injuries necessitated a period of recuperation ashore. On September 25, 1958, having obtained a certificate of fitness for duty, the libellant shipped out again.
