HOLMES, Justice.

The plaintiff in error, William H. Newby, hereinafter referred to as defendant, was convicted of involuntary manslaughter. The jury fixed his punishment at confinement in the State Penitentiary for not more than five years. The Trial Judge sentenced the defendant to confinement in the County Workhouse for a period of one year. The defendant's motion for new trial was overruled and he has perfected his appeal to this Court and assigned errors. The...
