Appellant, Voorhees-Jontz Lumber Company, filed suit in St. Joseph Superior Court to foreclose a mechanic's lien as a materialman against appellees Bezeks and C.E. Powell. Powell properly pleaded discharge in bankruptcy preventing any possibility of a judgment against him.
