This is an application for a writ of habeas corpus on the grounds that the applicant is being held in custody in violation of the Constitution of the United States. 28 U.S.C. § 2241(c)(3) (1959).

The applicant was convicted of burglary in the third degree and grand larceny in the second degree in the County Court of Dutchess County, and on July 14, 1959, was sentenced as a second felony offender to a term of five to ten years...
