On October 8, 1963 Clayton Bray brought this suit against Bryan Miller in a district court of Dallas County, Texas wherein he sought to recover damages growing out of alleged misrepresentations made by defendant to plaintiff concerning the condition of a house which defendant was to sell to plaintiff.
