Merlene Allen brought suit in Lipscomb County, Texas, for divorce against her husband, R. D. Allen, and for custody of their two minor children. The husband by cross-action sought a divorce and custody of the children. The case was originally tried before a jury, however the jury was unable to reach a verdict and it was discharged.
