Judgment modified on the law and the facts by striking out the provisions convicting and sentencing defendant for attempted murder in the first degree under count 1, and by dismissing such count from the indictment. As so modified, judgment affirmed.

The defendant was charged with being the planner for a group of robbers. His conviction rests on circumstantial evidence and on the testimony of two of the accomplices who participated in the actual attempted robbery...
