CARTER, Justice.

This is a suit for the partition of a quarter section of land in Lawson County, more specifically described in the judgment of the trial court. The trial court found that there was a life estate in existence in the land and that the owner thereof objected to its partition. The petition was thereupon dismissed. Plaintiff has appealed.
