Defendant John J. Vogel was convicted by a jury in the Monmouth County Court of robbery in violation of N.J.S. 2A:141-1. He was acquitted of the additional charge of armed robbery, N.J.S. 2A:151-5. His appeal to the Appellate Division was certified by this Court on its own motion. R.R. 1:10-1.
