This case was properly treated in the court below as a motion to vacate and set aside appellant's sentence pursuant to 28 U.S.C.A. § 2255. In denying the motion without a hearing, the lower court found that it was based upon the same grounds as a prior motion which had been decided adversely to Stephens; that the prior determination was on the merits after a full and fair hearing; and that the ends of justice would not be served by reaching the merits...
