The cause of action in this suit arises out of a very damaging fall down a back stairway of a residence which had been converted to an upstairs-downstairs duplex apartment. The defendants-appellants, George P. Smith and Arrilda P. Smith (husband and wife), are the owners of this duplex in Spokane. The Smiths rented the upper apartment to Mr. and Mrs. William Harris.
