This is an appeal from a City Court conviction of one Kenneth Baer for violation of subdivision 2 of section 722 of the New York Penal Law and section 38-a of chapter 16 of article 11 of the Revised General Ordinances of the City of Syracuse. There are three grounds urged on this appeal.
